Plugins for WordPress - Terms of Service
Introduction
These are general terms that you must accept in order to purchase and use one of our WordPress plugins. There may be additional terms specified when you select your license for purchase. Those terms will always take precedence over similar terms listed here (e.g. your product's license duration may override the general license duration given below). Accepting these terms also indicates you accept any such overriding terms.
Licensing
Your license is valid for one year from the date of purchase. During this time you will be entitled to free upgrades of the exact product you purchased. You will also have access to support services.
For Google Apps Login or Google Drive Embedder Enterprise plugins: The single-site license is valid on one designated WordPress installation, in conjunction with your Google Apps domain containing a number of users up to the maximum permitted by the license you purchased. If you purchased a multiple-site license (or 'unlimited'), each installation must be used in conjunction with the same Google Apps domains as each other only.
For other plugins: The license is valid on designated WordPress installation(s) up to the number of site licenses you purchased.
All licenses are non-transferable and must be used on a site owned by you, unless you are a developer or agency in which case you may use the plugin on a client site provided it counts as one of your designated sites. Support can only be obtained by you - your client will not be eligible for support directly.
The 'license' entitles you to support and receive product updates during the license term, but please note that even after the license expires you will be allowed to use the most recent version of the plugin that you obtained during the license term indefinitely under the same conditions as would have applied during the license term (other than the receipt of support and updates).
'Unlimited' site licenses mean you may install the plugin on as many sites as you require provided they can reasonably be described as 'your' sites or your client's sites (where you are contracted to build a significant portion of the site, and not solely contracted to host the site). You may not advertise the plugin for resale in any way.
If you only have one WordPress installation, but it is configured as "WordPress Multisite" then you should purchase the Unlimited Sites license. This license will allow your organization to use the product on one or more WordPress installations, which may all be in "Multisite" configuration, under the definition of 'unlimited' and 'your sites' above.
Support
Queries about installing and using the plugin should be emailed to [email protected]. Please indicate that you are using the premium plugin, especially if you are writing to us from a different email address than the one you used to purchase the license. For support requests received during business hours in the US, we will take reasonable steps to respond within 24 hours of receipt. For support requests not received during business hours in the US, we will take reasonable steps to respond within 24 hours of the start of the next working day.
In order to function, the plugins require one of the four most recent major release versions of WordPress at any time (e.g. 6.0, 6.1, 6.2, or 6.3 at a time when 6.3 is the latest release), and we reserve the right to refuse support queries for older installations or for particularly complicated configurations of newer versions (for example, you may have modified the WordPress core code, or have an unusual collection of plugins activated which may conflict with our plugins). In these cases, beyond the 14-day money-back guarantee period, we may issue a full or partial refund solely at our discretion.
We reserve the right to refuse to assist with support requests where you have chosen to modify the source code of our plugins.
Distribution
Upon purchasing the correct license for your Google Apps domain, you will be able to download a ZIP file containing the source code for the premium plugin. This is for use on at most the number of designated WordPress installations according to your license, in conjunction with exactly one Google Apps domain containing a number of users up to the maximum permitted by the license you purchased.
You are not permitted to redistribute the code to any third party or to use it for your own purposes on unlicensed sites. The only exception is that you may keep copies of the source code for your own archival purposes, for testing purposes within your own organization, or for the purposes of uploading the source code to your live WordPress installation.
You may modify the source code for use on your own site, but support may be limited in such cases (see above).
For further site licenses, we will be able to offer discounts, so please enquire via [email protected].
Refunds
Within 14 days of the date of purchase, you may request a full refund if you are not satisfied with the product, with no reason required. Please contact us via [email protected].
Communication
Upon completion of your purchase, the email address you entered for your contact details will be stored in our system. We will send you 'transactional' emails directly regarding your purchase (such as security warnings or advance notification that your license is due to expire. We will also add your email address to any relevant email distribution lists, such as one that provides ideas for getting the most out of your purchase, and those emails will each contain an 'unsubscribe' link so you can remove your email address from the list at any time. It is not possible to remove your email from our 'transactional' database without also agreeing to terminate your support license (which will only result in any refund if we so decide at our sole discretion or in accordance with our refund policy). We will never share your email address with any third party unless we have your permission or are required to do so by law.
Liability
THE AUTHOR OF THIS PLUGIN (WPAUTH, LLC) ACCEPTS NO LIABILITY FOR ANY DAMAGE WHATSOEVER RESULTING FROM THE USE OF THE PLUGIN. THE SOFTWARE IS PROVIDED “AS IS”, AND YOU ARE RESPONSIBLE FOR ENSURING THAT IT IS SECURE AND FIT FOR PURPOSE WITHIN YOUR OWN SITE INSTALLATION. THE AUTHOR’S LIABILITY IS STRICTLY LIMITED TO THE LICENSE FEE YOU PAID AT THE TIME OF PURCHASE.
The author may transfer ownership of this agreement to another third party at any time provided that the third party maintains the same terms as you.
Google APIs
The plugins may rely on API services offered by Google as part of a separate contract you have with them - through Google Apps or Gmail. We are not responsible for any changes to those APIs including outages, alterations to their functionality or method of invocation, or discontinuation. If permanent changes made by Google affect the functionality of our plugins, then only during the year-long support and update license, we will make reasonable attempts to work around those changes (if possible) within a reasonable time frame, but we cannot be liable for such changes.
